Legal terms for participation in the ‘Opina y Viaja’ promotion

 

  1. PROMOTING COMPANY OF THE PROMOTION

The company Dos And One Trilogic SL (baluka), with registered office in Vilassar de Mar (Barcelona) and identification number B01957497 (hereinafter 'the Company'), is organizing, for promotional purposes, the giveaway (hereinafter, “the Promotion”) at a national level, to be held online, exclusively for users residing in Spain who are of legal age, as set out in the participation conditions.

 

  1. START DATE AND END DATE

The Promotion will begin on May 22, 2023, and end on June 20, 2023.

The Company reserves the right not to proceed with the promotional action if, by the scheduled start date, fewer than 10 entries have been received. Likewise, the Company may extend the end date of the promotion by an additional 2 weeks, making the new closing date July 4, 2023, if more than 20 entries are received.

 

  1. PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

It's important to note that by entering the Contest, you fully accept and agree to the terms set out in these Legal Bases.

The participation requirements are as follows:

  • Participation is open to individuals residing in Spain who are of legal age.
  • Only those who are customers of the Company, have purchased the balukaDREAM product, and follow the giveaway rules will be eligible to participate.
  • The personal information provided by each participant must be accurate.
  • Participants will receive one entry for each video they submit.

 

To take part in the Promotion, simply send in a video sharing your opinion about the balukaDREAM product.

All customers who have purchased the balukaDREAM product on the baluka.es website are invited to record a video with their mobile phone sharing their thoughts about the product.

The video should be between 20 and 60 seconds long. If the video is longer than 60 seconds, we reserve the right to edit it to reduce its length.

The video must show the product (dog bed) with the participant's dog using it, along with the buyer's opinion. The following must appear:

  • balukaDREAM bed or mattress with the dog's name embroidered (if applicable)
  • Dog using the bed
  • Buyer sharing their opinion. It is NOT necessary for the buyer to appear on camera if they prefer not to; their voice is enough. The participant does not have to show their face in the video, but their voice must be present.
  • Do not include any graphics in the video (letters, emojis, etc.)
  • Well-lit
  • Acceptable video and audio quality
  • Record the video in vertical format
  • Send the video via WhatsApp to 605222111 along with your full name (must match the buyer's name)

 

 

  1. PROMOTION CONDITIONS AND PRIZES

One winner and one alternate will be chosen by draw from all videos that meet the conditions described above.

The draw will take place on June 22, 2023.

The winner will receive a Wonderbox experience gift code with the description “Traveling with my pet”, which includes 1 night + breakfast for 2 people and 1 pet at one of the 960 establishments selected by Wonderbox and available on their website, such as 4-star hotels, rural houses, inns, and more.

The reservation must be made according to the terms and dates set by Wonderbox for their product. You can book from the date you receive the gift for up to approximately 3 years later (the exact date will be shown on the gift voucher).

The Company will contact the winner via email and WhatsApp. If the winner does not respond within 10 days, a new draw will be held, excluding this participant.

The draw and the awarding of the prize are subject to current tax regulations.

The winner grants the Company the right to publish their name, first surname, and city of residence as the winner of the promotion.

All participants grant the Company the right to use the video they submitted for promotional, advertising, or any other purposes the Company deems appropriate to promote its product. The participant will not receive any benefit from the Company's use of the video, other than the gift if they are the winner.

Likewise, all participants grant the Company the right to edit their video, including shortening its duration, removing shots, deleting scenes, or adding graphics…

The Company is committed to using the video and its participants respectfully.

  1. LIMITATIONS

If it is found that any participant does not meet the requirements set out in the Terms, or if the information provided to participate is not valid, their participation will be considered void and they will be automatically excluded from the Promotion, losing any rights to the prizes awarded under this Promotion.

The following people are not eligible to participate in the Promotion: (I) Employees working for any of the companies or other legal entities linked to the Company (II) Individuals who participate directly or indirectly in the Company's capital (III) Any other individual who has participated directly or indirectly in organizing this Contest or has been involved directly or indirectly in its preparation or development (agencies, suppliers, etc.) (IV) Anyone who has received the product free of charge for promotional purposes through a prior agreement with the Company.

The prize awarded is non-transferable and cannot be changed, altered, or exchanged at the request of the Participants, nor can it be redeemed for any other product or for cash.

The Company reserves the right, for just cause and with prior legal notice, to make any changes, suspend, or extend this Promotion.

Any tax or fiscal charges that may arise from accepting the prize, as well as any other expenses related to the promotion not expressly covered by the Company in these Legal Terms, will be the sole responsibility of the winner.

You have a period of FIFTEEN (15) calendar days from the date the prize is awarded to submit any justified claim. The Company reserves the right, if necessary, to substitute the prize for another of similar characteristics.

 

  1. POSTING COMMENTS OR OPINIONS

Comments or opinions that are considered inappropriate, offensive, insulting, or discriminatory, or that could infringe on the rights of third parties, will not be allowed. Comments directed at individuals that violate the principles of the right to honor, personal and family privacy, or self-image will also not be permitted. We are not responsible for any harm caused by comments made by participants in the Promotion, which at any time could affect the feelings of other participants.

Any attempt to disrupt the proper conduct of the Contest, whether by human intervention or by automated means, will result in the immediate disqualification of the participant and cancellation of their entry.

 

  1. DISCLAIMER OF LIABILITY

By way of example, but not limited to, we are not responsible for possible losses, thefts, delays, or any other circumstances attributable to third parties that may affect the development of this Promotion. Nor are we responsible for the use the participant makes of the prize obtained from this Promotion, and we do not assume any responsibility for any damage or harm of any kind that Participants, the winner, or third parties may suffer.

We are not responsible for cases of force majeure or unforeseen circumstances that may prevent the Promotion from taking place or the full or partial enjoyment of the prize. If this Promotion cannot be carried out due to detected fraud, technical errors, or any other reason beyond the Company's control that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend it, including the participation website.

 

  1. FACEBOOK/INSTAGRAM

 

This promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook / Instagram or any other platform, so Participants release Facebook from any liability for any potential damages arising from it.

We take the protection of your privacy and personal data very seriously. That's why your information is kept safe and handled with the utmost care.

In accordance with the applicable data protection regulations, specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, regarding the protection of individuals with respect to the processing of personal data and the free movement of such data, each Participant, by accepting these Legal Terms, consents to the personal data provided for participation in this contest being included in a file owned by the Company, in order to manage participation in the contest and to notify the winner in case of winning.

We inform you that your personal contact details will be used for the following purposes:

Announce the winner's name

Participants guarantee that the personal data provided is accurate and are responsible for informing the Company of any changes. The Company reserves the right to exclude from this promotion any Participant who has provided false information. We recommend taking the utmost care in Data Protection by using security tools, as the Company cannot be held responsible for unlawful theft, modification, or loss of data.

Participants have the right to (I) access their personal data, (II) request correction of inaccurate data or, if applicable, request its deletion, (III) request restriction of data processing, (IV) object to data processing, and (V) request data portability. Participants can exercise all these rights by emailing hola@baluka.es and stating the reason for their request.

Without prejudice to any other administrative remedy or legal action, the Participant has the right to file a complaint with a Supervisory Authority, particularly in the Member State where they have their habitual residence, place of work, or where the alleged infringement took place, if they believe their personal data is not being processed in accordance with regulations, or if they are not satisfied with the exercise of their rights.

The Supervisory Authority handling the complaint will inform the claimant about the progress and outcome of the complaint.

  1. CHANGES

We reserve the right to modify or expand these promotional terms, as long as it does not harm or diminish the rights of participants in the Promotion.

 

  1. APPLICABLE LAW AND JURISDICTION

These legal terms will be governed in accordance with Spanish law. Any claim or dispute regarding the validity, interpretation, or fulfillment of these terms will be resolved by the Courts and Tribunals of the Participant's city.
